Women have been fighting for equal rights in the United States since 1848. About 175 years later, that fight has produced the right for women to vote, and have equal opportunities in education, careers, and pay.
But was the overturning of Roe v. Wade a step backwards for women’s rights?
What did Roe Actually Change?
According to the Washington Examiner, abortion is not illegal at the federal level. “The Constitution no longer guarantees the right to an abortion, but that does not mean access to the procedure has been removed nationwide.”
Abortion may be limited in some states after Roe v. Wade was overturned, but it did not take away rights for women. The changes in the law shifted where women can legally receive abortion in the United States.
What Rights Do Women Still Have for Healthcare?
Women can still receive the same prenatal and postpartum care that was available before Roe v. Wade with exams, ultrasounds, genetic testing, and etc.
According to the American Bar Association, Article 25 of the 1948 Universal Declaration of Human Rights provides, “Everyone has a right to a standard of living adequate for health and well-being of himself and his family, including food, clothing, housing and medical care . . . and the right to security in the event of sickness [and] disability. . . .”
However, healthcare is not actually a guaranteed right to any American.
The American Bar Association explains, “Many nations specifically include a right to health or a right to health care in their Constitution. The United States does not…Nevertheless, federal government support for health care has been in place for decades and benefits most, although not all, Americans.”
So, women have the same right to healthcare as men do. This was the case before Roe v. Wade, and remains the same after.
